M-96-008, REGULAR 112 <br />CONSTRUCTION MATERIALS RECLAMATION PERMIT APPLICATION <br />Dear Mr. Stanton: <br />On April 24, 1996, I received your response to my letter addressed to Western Gravel, Inc. <br />regarding their application fora 112 Constriction Materials Reclamation Permit for the North <br />R-34 Pit, File No. M-96-008. <br />Although, I do not have correspondence from the Applicant, naming you as an agent or as the <br />permitting contact regarding this application, I will respond tb your questions. <br />Exhibit :the application forms provide sample notices. I appreciate and understand that I had <br />the Certified Mail cards as proof of a mailing, however, without a copy of the notice that was <br />mailed or a statement from the recipient regarding what they had received, I have no way to <br />determine what the content of that mailing was. Therefore, my original request remains. <br />Exhibit S: the rules require that every exhibit be addressed and even empty exhibits should be <br />noted so that the reviewer is not left wondering if it was an oversight. <br />The grace period for using old forms only coveted the acceptance of the forms themselves. We <br />still have the requirements for all the necessary exhibits as outlined in the new rules which <br />became effective on January 2, 1996. <br />Regarding publishing, it should only be undertaken when this Office has found an application <br />to be complete, a determination to be made by the reviewer, not the applicant. I agree that this <br />point may not be entirely clear in the rules and in fact is to be subject to some rule changes for <br />clarification in the neu future. <br />
