.. • -4- If any of the Subject Lands should become patented and Lien fails to construct said lime plant within one year after the issuance of the final patent to the Subject Lands, this Mini- • mum Production Royalty shall then increase to Fifteen Thousnnd Dollars ($15,000.00) per year, commencing one year from the date of patenting. In any event, however, at such time as Lien completes construction of said lime plant, the Minimum Production Royalty here- under shall be reduced to five Thousand Dollars ($5,000.00) per year. The difference between the Five Thousand Dollar ($5,000.00) royalty and the higher royalty shall be prorated on a calendar-year basis. E. Termination of Lease Payment Obligations: Lien's obligations to pay Production Royalties or Minimum Production Royal- ties hereunder to Commercial shall terminate upon the expiration or termination of the lease granted hereby. 8. GRANT OF OPTION. PURCHASE PRICE. A. In Case of Patent of AlI of Subject Lairds: If all of the Subject Lands become patented before December 31, 1978, and fee simple title to all of the Subject Lands has by then become vested in Commercial, the purchase price of the Subject Lands shall be Three Hundred Fifty Thousand Dollars ($350,000.00). B. In case of Patent of A'one of the Subject Lands: If • none of the Subject Lands become patented before December 31, 1978, the purchase price of the Subject Lands shall be Two Hundred Thousand Dollars ($200,000.00).
