Ay Payment of Purchase Price grid Conveyance of <br />Title: This Lease and Option Agreement shall terminate, and both <br />parties hereto shall be released Prom any further liabilities or <br />obligations hereunder, including payment of royalties, at such <br />time as Lien pays to Commercial the purchase price of the Subject <br />Lands in full, less credits thereon, and Commercial conveys to <br />Lieu good acrd merchantable title to the Subject Lands. <br />II. Notice of Termination by Lien: Lien may terminate <br />this Lease •and Option Agreement by delivering to Couuuercial •..ritten <br />notice of its intention to terminate, grid ninety (rJ0) days after <br />• delivery of such notice, this Agxeentent shall terminate and both <br />parties hereunder shall be relieved from any further obli~atiuns <br />or liabilities hereunder. If Lien has not paid the full purchase <br />price, less credits, by such termination date, it shall not be <br />entitled to tho conveyance of ac2y interest hereunder from Commercial. <br />lu^^. ASSIGili,IENTS. Either Commercial or Lien may assign their <br />respective rights and obligations under this Lease and Option <br />Agreement and the assignee thereof shall have the sage rights and <br />obligations as the assignor. <br />• 1?. In tlce event that any duty or obligation <br />contained in this Agreement becomes impossible of performance by <br />Lien or Commercial by reason of a force majeure, such performance <br />shall be excused during the corctinuauce of the force majeure. The <br />term "force ncajeure" as used herein means acts of Cn~d, strikes, <br />fires, floods, riots, insurrections, inclement ~~ieather, government <br />restrictions or orders or any other matters beyond the reasonable <br />control of the parties hereto. <br />• <br />
