Dear Mr. Gerity:
I am writing to address several items that require further information to complete our adequacy review of your
reclamation permit application.
Rule 1.4.2(2.5) Proof of Notice: Please provide original green receipt cazds as demonstration of
proof of notice.
Rule 1.6.2(1)(e)Notification of Adiacent Landowners. Please note that the Division requires the
original green receipt cards to verify the notification of landowners within 200 feet of the affected
lands. There appeazs to be a landowner northeast of your proposed operation, east of the Bad Boys of
Cripple Creek. Please show this landowner on the surface owner map and provide proof of notice for
all surface owners within 200 fee[.
Exhibit C Minin¢ Plan (Rule 6.3.3(1)(b)): We understand that the area has been dismrbed in the
past and that topsoil may or may no[ exist in sufficient quantities on the site. The Division must,
however be assured that all topsoil encountered will be saved and be advised of the method in which
it is to be stored and protected. Please indicate the anticipated depth of soil growth medium that will
be salvaged, the method and location of storage, the method of preservation and show the proposed
stockpile on the map.
Exhibit C Minine Plan (Rule 6.3.3(1)(c)): Please indicate the location of the waste rock stockpile
on your mining plan map.
Exhibit C Minine Plan (Rule 6.3.3(1)(n)): In your introduction on page 1 of the application you
mention that "The production from the Burtis pit may include some gold in the matrix." It seems that
gold should be included as a possible secondary or incidental commodity to be mined.
Exhibit D Reclamation Plan (Rule 6.3.4(8): The estimate for the reclamation cost provided by the
independent contractor may not be reliable 10 years in the future. We have made assumptions and
calculated a reclamation cost of between $ 2,000 and $ 2,200 for the disturbed area. Please contact
