Also, there will be no onsite storage of fuels for <br />equipment, as fueling will take place from a mobile tanker truck. All precautions and <br />proper transfer procedures will be practiced when fueling equipment. <br />Exhibit E- Reclamation Plan: <br />.2~ This statement is true and is to be incorporated into the application. <br />Exhibit J -Vegetation Information: <br />As stated in corespondents to you of May 10, 1999 regarding this application, the <br />mine plan has been revised to avoid all areas of potential wetlands located in the <br />southwest portion of the permit area, north of the Arkansas River. Please see <br />Exhibit G that shows that the former Phase 1 has been left out of the excavation <br />areas and Phase 1 has taken the place of Phase 2. Consequently, there are a total <br />of four Phases instead of five and the total disturbed acreage is now 85 acres <br />instead of 120 in the North Mining Area. <br />Exhibit L -Reclamation Costs: <br />1. The applicant is in agreement with this procedure. <br />Exhibit S -Permanent Man-Made Structures: <br />1.f Attached as part this Second Response Letter is a more definitive letter of <br />agreement between the applicant and David Coulter regarding responsibility to repair <br />any damage caused by the applicant's mining to the Coulter's alluvial wells and <br />power line. <br />2. As stated in corespondents to you of May 10, 1999 regarding this application, the <br />mine plan (Exhibit C) has been slightly modified to show that there is greater than <br />200 ft. of separation between the BN & SF power line located south of the south- <br />central portion of the permit area and excavation of the South Borrow Pit. Also, the <br />limit of excavation of the South Borrow Area comes no closer than 350 ft. from the <br />active railroad tracks. Please see Exhibit C. <br />The responses given above should satisfy all concerns raised in the CDMG Adequacy <br />Letter of April 12, 1999, and not previously addressed, and the Second Adequacy Letter <br />of May 10, 1999 for the North River Pit application. <br />The applicant and ourselves assume that given that the above-responses and the <br />corrected map exhibits (Exhibits C and F) are satisfactory to the Division in content and <br />commitment, that this application should receive a recommendation of approval for a <br />"112" Reclamation Permit from the Colorado Mined Land Reclamation Board. If this is <br />not the case, please contact us as soon as possible so that we can rectify any remaining <br />concerns that the Division may have. <br />
