Portions of the documents (addresses, <br />and telephone numbers) were redacted in accordance widt FOIA Exemption 6, which <br />states: "Personnel and medical files and similar files dre disclosure of which would <br />constitute a clearly unwarranted invasion of personal privacy." 43 CFR Part 2 Subpart B, <br />Section 2.13(c)(6). <br />Additionally, two E-Mail messages and three pages of draft correspondence were widilteld <br />per the pre-decisional and deliberative process privileges of Exemption 5 of the FOIA, <br />which states: "Inter-agency or intro-agency memorandums or letters which would not be <br />available by law to a party other than an agency in litigation with the agency." 43 CFR <br />Part 2, Subpart B, Section 2.13(c)(5). Disclosure of such material would inhibit dte open <br />and candid expression of such views in sunilar future deliberations, could confuse the <br />public as to the official agency position on an issue, and have a detrimental effect on our <br />decision making process. <br />Also, a map depicting archaeological locations is exempt from disclosure pursuant to the <br />Archaeological Resources Protection Act (ARPA) of 1979, 16 U.S.C. 470hh(a), and <br />Exemption 3 of the FOIA. <br />As a non-conunercial requester, you are allowed the first 100 copies and two hours search <br />and review time free of charge. The remaining fee is less than $]5.00 therefore, the <br />records are being provided to you at no charge. <br />
