<br />3. Neighbors for a Desirable Perk County, Inc., pursuant to said Contract, has as interest in
<br />the reserved mineral interests with respect to a portion of the Cargill Ranch, to wit The
<br />SE Y, SW %, of Section 11, and the NW '/. of Suction, 14, all in Township l0 5outlr,
<br />Range 77 West of the 5"' P.M., in Park Comrty, Colorado.
<br />4. The reservation of `other minerals" contained in said Wazranty Dced includes and applies
<br />to gold and other heavy metals, and also includes and applies to sand and gravel
<br />contained on said premises. 1n partial suppoR of this allegation, see the AfSdavit of
<br />Robert Cargill, incorporated herein and attached hereto as Exhibi[ $. -
<br />5. Defendants, the heirs and/or devisees of N.C. Cargill and/or Lora E. Cazgill, may claim
<br />an interest in and to the mural interests in the real property which is the subject matter
<br />of this action by virtue of the reservation of one-half of all the oil, gas, and other minerals
<br />wntained in that Warranty Deed recorded on Juty 15, 1963 at Book 180, Page 135, of the
<br />. Park County Records.
<br />6. Defendants, Jack R. Alien and Susanne R. Allen, may claim an interest in and to the
<br />mineral interests in the real property which is the subject matter of this action by virtue of
<br />a Warranty Dced recorded on March 7, 2005 under Reception No- 610775, (and 6]0777),
<br />of the Perk Coumy records..
<br />7. Defendant, Park County, may claim an interest in and to the mineral interests in tha real
<br />property which is the subject matter of this action by virtue of a Warranty Deed recorded .
<br />on November 1, 1982 at Book 346, Page 487 of the Park County records.
<br />8. Defendant, Bruce R. Plankinton, may claim an interest im and to the mineral interests in
<br />the real pmperty which is the subject matter of this action by virtue of a Warranty Deed
<br />recorded on August 17, 2001 under Reception No. 549961 of the Park County records.
<br />9. Defendant, P1anlintotr Family Limrted Partnership, may claim an interest in and to the
<br />mineral interests in the real property which is the subject %atter of this action by virtue of
<br />a Warranty Deed recorded on October 2b, 1998 under Recpption No. 497225 of the Park
<br />County recoils, and by virtue of the Deed recorded on March 7, 2005 under Reception
<br />No. 610774.
<br />10. Defendan[, River Ranch Restoration Company, LLC, may clam an interest in and to the
<br />mineral interests in the real property which is the subject matter of this action by virtue of
<br />a Warranty Deed recptded on June 30, 2004 under Reception No. 601249.
