ID: NOV 14'94 14:18 No .006 P.03 • STIPULATIONS At the time of permit issuance (October 31, 1994), the following exploration boreholes are fully approved for drilling subject to the stipulations below: PEDS-1, PEDS-2, PEDS-3, PEDS-9, and PEDS-10. 1) A 1 /4 mile buffer zone shall be m.:intained between drill sites and the Yampa River and all raptor nests during the wi.:ter and spring months. 2) Discharge of water from artesian :,oreholes may proceed only after the Division has received a copy of the Conatr,~ction Dewatering Permit to be issued by CHOH. If artesian flow is encountered in :: borehole prior to the issuance of the Construction Dewatering Permit, ',hen a) the hole must be capped to prevent discharge until the Construction Cawatering Permit is issued, or b) the water must be discharged to a storage tank c; vac truck until the Construction Dewatering Permit is issued. 3) All conditions stipulated in all lea:~as, agreements, clearances and associated permits issued by the BLM, CDOF:, CDOW, USFWS and landowners must be edharod to. The remaining boreholes proposed under the N01 are subject to the above stipulations as well as the stipulations outlined below: 4) Site preparation and drilling of an~r particular borehole may commence only after the Division has received a copy cf the cultural resources clearance for that particular site from the BLM. Any conditions set forth in the cultural resources must be complied with. 5) Site preparation and drilling of am/ particular borehole may commence only after the Division has received a copy of the threatened and endangered species clearance for that particular site foam CDOW and USFWS.
