<br />SECTION E - IMPACTS AND RECLAMATION <br />Further Land Development <br />Most of the land development in the area is now subject <br />to the Colorado Open Mining Land Reclamation Act of 1973, <br />which states at 92-36-5: <br />"Preservation of Commercial Mineral Deposits for <br />Extraction. <br />(1) After July 1, 1973, no board of county commissioners, <br />governing body of any city and county, city or town, or <br />other governmental authority which has control over zoning <br />shall by zoning, rezoning, granting a variance, or other <br />official action or inaction, permit the use of any area <br />known to contain a commercial mineral deposit in a manner <br />which would interfere with the present or future extraction <br />of such deposit by an extractor." <br />Much of the area is included in the survey of commercial <br />mineral deposits in the populous counties of Colorado, as <br />stated in the State Geological Survey, Department of Natural <br />Resources Special Publication 5-A, "sand, Gravel and Quarry <br />Aggregate Resources Colorado; Front Range Counties, 1 ~+." <br />Under this constraint, plus additional county zoning limi- <br />tations of flood plain--mineral conservation, further development <br />in subject area will require extraction of proven existing min- <br />eral deposits as first step with the proposed reclamation plan <br />as the ultimate use. <br />Conclusion <br />The recent historic land use in the subject area has been <br />irrigated pasture--limited crop production in the flood plain. <br />Adams County has recently changed the zoning to M.C. - Mineral <br />Conservation, for the purpose of Mineral extraction. <br />Adams County under past planning policies and practice <br />has encouraged and regulated "open" - agricultural uses be- <br />cause of flood hazard in the subject area. <br />Adams County has also, through the establishment of M.C.- <br />Mineral Conservation zoning in 1969, encouraged conservation <br />of proven mineral resource areas for .future use and reclamation. <br />As it seems logical that this already established "open" <br />- Flood Plain - Mineral Extraction policy would continue, re- <br />inforced by state policy (laws), we believe that our mining <br />and subsequent reclamation activities are in line and compatible ~ <br />with present and future land use policies of the state and county. <br />-6- <br />
