Mr. Roman V. Bockus
March 4, 1976
Page Three
Three major irrigation systems, the Brantner, Brighton and
Fulton Ditches, divert water from the South Platte River
in this vicinity with combined average annual diversions on
the order of 40,000 acre feet per year. The diversion of
this water, its use for irrigation and its return to the
stream in downstream locations, also contributes to the
poor quality of the water in the river. It is not anticip-
ated that the mining operation will discharge water directly
to the river, and any water pumped from the excavation
operation would be at least equal in quality to that of the
river at the present time. Under the completed reclamation
plan, water in the excavated areas would be part of the
regional ground water table and would reach t;~e river only
after flowing through the sands and gravels, and would not
have any adverse impact on the quality of water in the river.
WATER RIGHTS
There are 20 shares of the Fulton Irrigating Ditch Company
attached to the property. These shares have historically
been used to irrigate approximately 41 acres of the eastern
portion of the sita with an annual consumptive use of 53.3
acre-feet. [dater is delivered to the site by a lateral from
the Fulton Ditch. The Fulton Ditch irrigates an estimated
12,000 acres of farmland along the east side of the South
Platte River between a point six miles upstream from Henderson
to approximately three miles southeast of Platteville. Some
of the lands irrigated by the Fulton Ditch are river bottom
lands and some are adjacent terrace lands.
Decrees owned by the Fulton Irrigation Ditch Company are as
follows:
Priority
8
43
51
Appropriation
date
05/01/1865
07/08/1876
11/05/1879
Diversions to the Fulton Ditch for the 10 year
through 1973 are contained in Table 1.
