Peabody Coal Company requests a variance from the requirement to conduct <br />annual sediment surveys of these sedimentation ponds. In accordance <br />with Rule 4.05.6(11)(c), Peabody visually inspects each pond a minimum of quarterly each <br />year. During these inspections, any drastic change in sediment storage or sudden <br />increases in a sediment delta at the inlet to the pond could be detected which would <br />require mitigatory action. <br />• <br />7-11A-10 <br />
