Dear Mr. Wayland:
On June 25, 2004, the Division of Minerals and Geology received your 112 Construction Materials Reclamation Permit
Application package for the File Pit 112, File No. M-2004-04'7. Preliminary review of the information received
determined that the following items must be received before the Division can consider your application as being
submitted and technical review can begin:

June 25, 2004 is no longer an application form approved by the Mined Land Reclamation Board. An approved
form is enclosed for your use. Item No. 3 on the application form received on June 25, 2004 was not completed.
You must provide the source of the
Opentor'slApplicarn's legal right to enter and initiate a mining operation on the affected land (Same
requirements as Rule 6.3.7). You may provide a copy of Farfnunwurkin, LLLP's deed, abstract of title, or a
correct. tax receipt. You must also provide a signed statemerrt by the other Landowners that is acknowledged by
a Notary Public stating that the Operator/Applicant has legal right to ewer and mine.

demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected
land will not be adversely affected or you must provide a notarized agreement between the applicant and the
person(s) having an interest in the structures, that the appGcam is to provide compensation for a~ damage to
the structures.

filing the application, post notices (signs) at the location of the proposed mine site, as required by the Office, of
sufficient size and number to clearly identify the site as the location of a proposed mining operation giving name,
address, and phone number of the Applicant, and stating that (name of Appiicaat) has applied for a mining
permit with the Colorado Mined Land Reclamation $oazd. Anyone wishing to comment on the application may
view the application at the County Clerk's or Recorder's office and should set3d comments prior to the end of the
public comment period to the Colorado Mined Land Reclamation Office, at the address given on the cover of
these Rules and Regulations. Any class of Limited Impact 110 or 110d operation need only post notice (sign) at
the location of the proposed access to the site. After having posted such notice (sign), failure by an Apphcaat to
maintain such notice shall not constiiute just cause to deny approval of the application. At the time the
application is &led with the Office, the Applicant shall provide a signed affidavit that such notice (sign) was
postal according to the provisions of this Rule.
