("Bear Coal Company") is a Colorado <br />corporation currently conducting underground coal mining operations in <br />an area directly east of Somerset, in Gunnison County, Colorado. The <br />operations of Bear Coal Company consist of a complex of two small room <br />and pillar mining areas known as the Bear Mines No. 1, 2. All of the <br />Bear Coal Company operations are covered by Extraction and Development <br />Permit No. 77-241, issued by the Colorado Mined Land Reclamation Board <br />("MLRB"). This permit has been amended to affect compliance with the <br />Regulations pursuant to Section 502 of the Surface Mining Control and <br />Reclamation Act and the Regulations at 30 CFR Sec. 700.1 et seq• In <br />addition, Bear Mines No. 1 and 2 are included within an approved Federal <br />Mining Plan pursuant to the Regulations at 30 CFR Sec. 211.10. <br />Accompanying this letter is a permit revision with respect to the Bear <br />No. 3 Portal only. This revision is specifically directed at compliance <br />with the Colorado Surface Coal Mine Reclamation Act, D.R.S., 1973, <br />Section 34-33-101 et sec, and the recently promulgated Colorado <br />Regulations. The revision has been developed under a format following <br />the Colorado Regulatory Program. The net effect of this request is to <br />allow for the mining of an area of federal coal directly adjacent to the <br />existing Bear No. 1 and 2 Portals. <br />The Bear Coal Company revision to revise its mining plan for Colorado <br />and Federal permits must be approved in order to maintain employment and <br />production levels and to meet market commitments. Without regulatory <br />approval of the accompanying revision, Bear Coal Company coal production <br />will plummet, and its operations will be severely curtailed. <br /> <br />
