County Road #7 <br />Fort Collins, Colorado 8052 <br />Dear Louis: <br />MANAGEMENT <br />CONSULTANTS <br />-G' SEVEdrEENTH Sr SUITE 3'.0 <br />DEt,.E= C~~LCRaD03.7C2 USa <br />7E~E-,or,E ~sc~, r- a~os <br />'ELE==F ~.3]J) 227 ~'-- <br />September 21, 1999 <br />Swift Ponds, Timnath Connell Pit Application, File #iv1-99-065 <br />I received this morning a draft copy of a Maintenance Covenant forwarded to you from Connell <br />Resources. it is understood that the purpose of this agreement is to protect the quantity and quality of <br />the historic use of groundwater. During April of this year, Connell Resources had installed five <br />piezometers around the perimeter of the proposed mining area, and groundwater level data are <br />available for the period April 12 to September 14, 1999. Two of the piezometers (#2 and #4) are <br />located close to Boxelder Ditch and have experienced water level variations of 3.35 and 5.7 feet, <br />respectively. Piezometer #3, located on the eastern boundary of the property and influenced by the <br />Cache La Poudre River water levels, has indicated a maximum water level change of 5.25 feet. <br />However, piezometers #1 and #5, located on the western property boundary' and away from the direct <br />influence of the Boxelder Ditch and the Cache La Poudre River, have experienced maximum water <br />level changes of 1.95 and 1.00 feet, respectively. <br />Following conversations with you, 1 understand that the historic water levels within your ponds have <br />not varied more than 1.0 to 1.3 feet during the last 20 to 25 years. An elevation benchmark has been <br />established at Swift Ponds by Sears-Brown engineers, and I recommend that all elevations in the <br />future should be based on this or other established USGS benchmarks. Within item #2) of the above <br />referenced letter, I would recommend that the following items are also stipulated as part of and <br />included within the agreement. <br />• The monitoring and reporting plan will be developed jointly by the undersigned or <br />their representatives and will include the four new piezometers and those currently <br />existing on the proposed mine area. Connell agrees to monitor all of these <br />piezometers during the total mining period and forward a copy of the results to <br />Mr. Swift on a quarterly basis. <br />• Connell will provide an easement to the piezometers on their property to allow access <br />by Mr. Swift or his representative for validation of the groundwater levels at any time <br />during and following completion of the mining operations. <br />
