Mr. Don Marostica
May 16, 2000
Page Two
We are aware that the site plan, dated October 18, 1995, which you and [he City of
Loveland provided [o us, shows floodway, and floodplain lines, that are substantially
different from [he lines depicted on the current FEMA map referenced in [he previous
paragraph. On the site plan there is reference to a "Curren[ Floodway," "100 year Flood
Plain Limit," and "500 Year Flood Plain Limit." These reference a study, conducted in
1981 by Resource Consultants, Inc., a study that was never officially recognized by
FEMA, the City of Loveland, or Larimer County, as being the regulated limits of the
floodway or floodplain. We have contacted FEMA, Larimer County, the City of
Loveland, and the consultant to whom you referred us, Mr. Dan Gregory, of ENSR, and
have determined that the regulated floodway, as recognized by all of these entities, is the
one depicted on the FEMA map dated 1979; consequently it is that information that we
are using as the basis of our current study. Furthermore, a line on your site plan
identified as "Floodway Boundary fora 1.0' surcharge as modified by ConsultanP' is not
recognized by the entities named above as being a regulated limit, and as far as we have
been able to determine through contacting the consultant and government agencies, has
never been modeled to show its feasibility.
We expect that the study currently underway at Simons & Associates will be complete
within the next two weeks. At that time, we will modify our current mining and
reclamation plans, if necessary. We will be meeting with adjacent property owners to
share the results of the study and respond to their co~rcerns. We appreciate your interest
in this matter and will be contacting you soon to arrange a meeting. In the meantime,
please call me with any questions or comments.
Respectfully,
~~~~~~
Julie Goettemoeller
Senior Land Manager
CC: Colorado Division of Minerals and Geology
Sean Wheeler, Larimer County Planning
Matt Dulcich, City of Loveland
Don Taranto, TST, Inc., Consulting Engineers
Robert Simon, Ph.D, Simons & Associates, Inc. w/ Marostica Attachment
Rex Bums, Larimer County Engineering w/ Marostica Attachment
