Koblitz, <br />This letter is in further response to item '_~ or the Colorado Department of <br />\linerals and Geolog~~'s [arch 3, 199- list of concerns on the application for a <br />. mining permit filed by torencito Coal Compam~, LtC, as set forth in their letter of <br />\'Iav 2-, 199'. <br />I ha~:e attached te.o provisions from the Coal Lease Agreement bet~.veen the <br />land owners, Hilts and \tGP Enterprises, and A.P. Maxwell Development Company, <br />LLC. (As you know, A.P. ~(axecell subsequently assigned its interests to Lorencito <br />Coal Company, LLC.) Paragraph 2S(a) of the Lease, on pages 20 - 21, requires that the <br />terms of the lease be kept confidential, although paragraph Z5(b), on pave 26, <br />contains an exception where disclosure is required b}' lacy. Because of these <br />confidentiality restrictions, only the ~[emorandum of tease Agreement was <br />previously provided to the Division as Exhibit ? to the permit application. <br />However, since the Division is now reauirine evidence of the right to <br />construct a rail spur, I have attached an excerpt from page Z of the Lease, which <br />contains Paragraph l.g.
