Memorandum to Corey Hoffmann <br />November 14, 2005 <br />Page 15 <br />Board Jurisdiction: Rule 3.13 requires that all reclamation shall be carried to completion <br />by the Operator with all reasonable diligence, and each phase of reclamation shall be <br />completed within 5 years from the date the Operator informs the Board or Division that <br />such phase has commenced (unless extended by the Board or Division). The 5-year <br />period may be applied separately to each phase as it is commenced throughout the life of <br />the mine. Rule 3.1.10(1) states that "In those areas where revegetation is part of the <br />Reclamation Plan, land shall be revegetated in such a way as to establish a diverse <br />effective, and long-lasting vegetative cover that is capable of self-regeneration without <br />continued dependence on irrigation, soil amendments or fertilizer, and is at least equal in <br />extent of cover to the natural vegetation of the surrounding area." (Emphasis added.) <br />Rule 3.1.10(5) requires that, "To insure the establishment of a diverse and long-lasting <br />vegetative cover, the Operator shall employ appropriate techniques of site preparation <br />and protection such as mechanical soil conditioning by discing and ripping; mulching; <br />soil amendments and fertilizers; and ircigation." Rule 4.2.1(1) requires that all Financial <br />Warranties shall be set and maintained at a level which reflects the actual current cost of <br />fulfilling the requirements of the Reclamation Plan. <br />(For further supporting documentation, see Exhibit 19.) <br />• In summary, the MLRB must deny the application based on its many shortcomings and <br />insufficiencies. Yet, in the event that the MLRB does not deny the application, in order to <br />ensure compliance with the relevant statutory and regulatory requirements that the Applicant has <br />failed to meet so far (despite the numerous extensions and reschedulings that have occurred for <br />this application) -and in order to protect identified financial, governmental, and public health <br />and safety concerns -the foregoing conditions must be imposed as conditions of approval. <br />Please contact me if you have any questions or require additional information. <br />• <br />LEONARD RICE ENGINEERS.
