Proposed condition: The Applicant shall conduct apre-blast survey of all potentially <br />affected off-site structures within 200 feet of the affected lands as required in the Division's <br />September 12, 2005, 3`d Adequacy Review comments (from Allen Sorenson). The survey <br />shall be conducted in accordance with the Off-ice of Surface Mining and Enforcement's <br />(OSMRE) Blasting Guidance Manual (1987), and Section 816.62 of the OSMRE <br />regulations. <br />The operator shall determine the condition of the structures and shall document other <br />physical factors that could reasonably be affected by the blasting. The survey shall include <br />all structures and sensitive receptors within those structures that have the potential for <br />adverse impacts resulting from blasting operations including but not limited to: <br />1. Buildings; <br />2. Foundations; <br />3. HVAC and odor control systems; <br />4. Mechanical equipment including pumps, pipes, valves, and other related <br />appurtenances; <br />5. Wastewater treatment process-related equipment including aeration basins, <br />clarifiers, filters, bio-solids handling, and ultraviolet light disinfection systems; and <br />6. Process monitoring equipment including all sensors (level, flow, and water quality), <br />• instrumentation, and supervisory control and data acquisition (SCADA) systems <br />related to wastewater treatment plant operations. <br />7. Highway lighting and related power transmission and control systems. <br />The survey shall be conducted by a licensed Professional Engineer, registered in the State <br />of Colorado, who is Familiar with the above appurtenances and the potential impacts of <br />external shock and vibration upon their condition and operations. The engineer <br />conducting the survey shall sign and stamp the written report. Prior to commencing <br />blasting operations, the survey shall be submitted to the Division, the Black Hawk Fire <br />Department, the Black Hawk-Central City Sanitation District, the Silver Dollar <br />Metropolitan District, and all other owners of off-site structures within 200 feet of the <br />affected lands, in sufficient time to allow for appropriate review and comment, and in <br />sufficient time to allow the named parties to appeal the permit conditions. Blasting shall <br />not commence until the pre-blast survey is accepted in writing by the Division. <br />Board Jurisdiction: Rule 6.4.19 (Exhibit S -Permanent Man-made Structures) requires <br />that, where a notarized agreement or letter cannot be obtained for structures within two <br />hundred feet of the affected land, the Applicant shall provide an appropriate engineering <br />evaluation demonstrating that such structures shall not be damaged by blasting and other <br />activities. Rule 6.1.2 requires that 112 Reclamation Permit operations "shall provide all <br />the Exhibits, as described in [Rule] 6.4 ...." Rule 6.1.] requires these Exhibits to be <br />submitted with the permit application. All of the information required as part of Exhibit <br />S must therefore be included as part of the application.
