Any violation of a rule, regulation, permit, or plan may result in the <br />scheduling of a Show/Cause Hearing to consider the revocation of Special Use Permit No. <br />1999-007. <br />12. Special Use Permit No. 1999-007 shall be placed on a one-year review. <br />NOTE: Section 36(I) of the Pueblo County Zoning Resolution provides that the action or activity <br />authorized by a special use permit must be exercised in full or construction started within one <br />year of the date of the Planning Commission's approval or the special use permit becomes null <br />and void unless the permit is extended by the Commission. Further, the action or activity must <br />be in full compliance with all conditions of the special use permit. Please note that merely <br />obtaining necessary building permits, other local, State, or Federal operating permits, and <br />entering into agreements does not constitute an exercise in full or starting construction. <br />LOCATION <br />The property is located north of the Arkansas River, approximately Y: mile south of State <br />Highway 50 East, and west of Nyberg Road. The property is legally described as a portion of <br />Sections 35 and 36, Township 20 South, Range 63 West, and portions of Sections 1 and 2, <br />Township 21 South, Range 63 West of the 6`h P.M. {Exhibits 3-8). <br />BACKGROUND <br />LaFarge, Inc. has leased 4481 acres from C.R. Evans, for the purposes of conducting a sand <br />and gravel operation. The applicant has applied for a Mined Land Reclamation Board 112 <br />Permit. The operation will be a wet pit, de-watered for mining. Current land use of the proposed <br />mining area consists of irrigated agriculture and non-irrigated rangeland. The applicant owns <br />adjacent property along the river, and will haul materials from the site, through existing haul <br />roads on their own property, to the main plant, which was approved under Special Use Permit <br />No. 570. <br />The applicant intends to maintain a 200-foot no-mining buffer zone from the westerly right-of- <br />way of Nyberg Road, and from the south boundary of the lease property. A minimum 200 foot <br />no-mining buffer zone shall be established along the north bank of the Arkansas River, and a 50 <br />foot buffer zone shall be maintained along the west fence of the proposed site. A processing <br />plant site is proposed within the northwest portion of the lease property (Exhibit 7). Mining will <br />not occur within the processing area, which will be used for a wash plant, crushing, screening, <br />and stockpiles, or within the river. <br />The existing Excelsior Ditch Road used by the Ditch Company will be extended to the southeast <br />along the property line between the Evans property and the Rich Pit -LaFarge property. The <br />existing haul road will be watered during use to control dust. The estimated life of the pit is 60 <br />years, at approximately five (5) acres mined per year. The proposed direction of mining and <br />reclamation is depicted on the Mining Plan Map (Exhibit 7). <br />The property owner intends 300 surface acres of the site to be reclaimed as a permanent lake, <br />for recreation (Exhibit 8), The scope of recreational use has not been determined.
