2.03.5 -COMPLIANCE INFORMATION <br />Neither National King Coal, LLC nor persons controlled or under common control <br />has had a Federal or State mining permit for surface or underground mining <br />operations suspended or revoked in the last five year period since date of issuance of <br />CDMG Mining Permit C-81-035. <br />Neither National King Coal, LLC nor persons controlled or under common control <br />has forfeited a mining bond or similar security deposited in lieu of bond. <br />One violation has been issued to National King Coal, LLC during the three years <br />prior to this application. <br />CV-2002-014 was issued by the Colorado Division of Minerals and Geology, on July <br />9, 2002, for mining too close to an occupied dwelling, not maintaining required <br />buffer. <br />The required abatement was undertaken by filling in subsidence cracks, testing <br />sewer and septic lines, repairing cracks to rock wall and basement and installing <br />monitoring stations around the house and slab and vertical wall. <br />The violation was terminated by CDMG on October 25, 2002 <br />ni~imiyiisii~oiiiiirri~oimiiiuioriiiimooiim~iiiiioiooiioimioiiiioiioiuioiiiiiumMioii~iiMioi~oiiiiiioii~iiiioivioioio~i <br />National King Coal, LLC King I Mine <br />Section 2.03.5 <br />Page 1 March, 2006 <br />
