Dc9i. <br />Re Second Adequacy Letter <br />ROBCO's Chieftain South Mine <br />MLR File No. 81-148 <br />This letter responds to your second adequacy letter dated <br />September 3, 1981. LVe delayed replying to your letter until <br />we learned what changes, if any, might be necessary because <br />oP the issue of "compliance with county zoning." At this time, <br />it appears no changes are required. It is our understanding <br />that you will be hearing from Mr. Belmore T. Martin, attorney <br />for ROBCO, on this matter. <br />Our responses follow the paragraph numbering system used in <br />your September 13 letter. <br />Mining Plan <br />1. Thank you Por your agreement on this item. <br />2. Contours on Map Exhibit D-1 indicate horizontal to vertical <br />gradients will vary from 2 to 1 on the slopes. to 50 to 1 <br />on the pit floor. S9e intend to follow this plan. The <br />settling pond located at the south end will cover about <br />0.4t acres with a depth of about 3 feet. In a no-silt <br />condition, this pond could hold a maximum of 1.2t acre- <br />feet of water. Admittedly, this is very little water, but <br />the capacity is sufficient !or our needs. We appreciate <br />your defining "significant" for us; now if you will give us <br />your definitio^ of "large" we can be specific. Joking aside, <br />we do not believe this very tiny pond has the potential <br />for the type of damage you are concerned with. <br />3. Weekly, if needed. <br />4. Basically, this is an overflow pond, but under "usual" con- <br />ditions water will leave the pond by evaporation. Under <br />cloudburst conditions it might overflow. Remember, please, <br />that this is a dry operation; we abhor water in the pit. <br />
