Letter to Jerry Worthley
Page 2
U.S. Army Corps of 8ngineere
Southern Colorado Project office
720 North Main Street, Suite 205
Pueblo, CO 81003-3046
719/543-9459
-,
It ie my understanding that you will need to submit your concerns/request
to the COE in writing, and that you will have a defined timeframe in which to do
this, once the dredge and fill permit application is filed. He. Culp can notify
you of the filing date and the timelines for submitting your comments. In
conjunction with the dredge and fill permit, my agency will undertake an
antidegradation analysis and certify that the quality of the water will or will
not be adversely affected by the proposed mining operation.
My consultations with WQCD hydrogeologiate and with the DHG indicate that
the applicant has taken the steps needed to minimize the impacts to water quality
from the proposed gravel mining and processing operation. The WQCD will continue
to monitor the operation through the discharge monitoring reports that will be
filed on a scheduled basis; the DMG will address water quality considerations in
the reclamation permit.
You may be aware that the DHG will conduct a prehearinq conference on the
Agile Stone Systems permit application on Monday, Harch 16th, at 1:00 p.m. in the
Canon City Council Meeting room located at 612 Royal Gorge Boulevard in Canon
City. This would be a convenient opportunity for you to raise your concerns
prior to the public hearing on the permit. I am enclosing a copy of the
announcement for the conference for your reference. If possible, I would also
encourage you to attend the public hearing on the permit scheduled before the
Mined Land Reclamation Board on March 25th or 26th, 9:00 a.m. at 1313 Sherman
Street in Denver. Ms. Glenda Williams develops the Board'^ agenda and w111 be
able to tell you', after Harch 20th, which day the hearing will be held. She can
be reached at 303/866-3567.
Z understand your concern about the impacts on your well and your property,
and am hopeful that they can be addressed in a satisfactory manner through the
state and federal permitting processes. I hope that this letter adequately
explains the measures taken by the state permitting agencies to protect the
integrity of the water. If you have any additional concerns about the water
quality impacts of the proposed gravel mining operation, please don't hesitate
to contact me at 303/692-3573.
Sincerely,
Rath'tae~ neR 1 ly, Wat shed Coordinator
Arkansas Q Rio Grand Basin
WATER QUALITY CONTRO DIVISION
Enclosure
cc: Anita Culp, U.S. Army Corps of Engineers
~,~Glenda Williams, Division of Minerals & Geology
Phil Heqeman, WQCD, Permits Unit
Watershed File
