The Applicant informs the Board that that lawsuit has now been settled and the Applicant <br />wishes to post a bond and to begin mining gravel from the site. <br />The Division has reviewed the application and raised concems about matters such as the <br />financial warranty amount, mining depth to water table, noxious weeds, designation of the <br />site as a National Wildlife Refuge, potential Endangered Species Act concems and other <br />matters. <br />6. The Division requested that this item be continued until the December meeting of the Board <br />so that the parties may meet and discuss the changes that have occurred since 1987. <br />Considering the date of the application and the settlement of the Applicant's lawsuit with the <br />United States Department of Energy, it is appropriate that this matter be continued until the <br />December Board hearing. <br />ORDER <br />Based on the foregoing findings of fact- and conclusions of law, the Board <br />orders that this matter be continued to the December, 2003 meeting of the <br />Board. <br />DATED this l~ ~ day of ,r~~~?,~.4~r~ , 2003. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />Ira Paulin, Chairma~~i~M ed Ly'"~'!/ <br />Reclamation Board <br />
