We have received a copy of the reclamation permit application notice and/or an inspection report for
the site, from the Colorado Division of Minerals and Geology (formerly the Mined Land Reclamation
Division). The Water Quality Control Division administer; a stormwater program, designed to
control stotmwater runoff from certain categories of industrial activity, including mining. Your
facility falls under one of these categories. Our records indicate that you have not applied for or
obtained a stormwater permit for the above-referenced mining operation.
Background
Jn 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges
from mining sites (cud other industries) as requiring Clean Water Act controls. In 1990, EPA issued
regulations that require specific mining activities to obtain permits in order to discharge stormwater
from their facilities.
The stormwater regulations apply to active and inactive mines, if runoff contacts overburden, raw
material, intermediate or fuvshed product, or waste products, and leaves the site.
The Water Quality Control Division of the Colorado Department of Public Health and Environment
has direction and authority to administer this program in Colorado. The Division has issued a general
permit for Sand and Gravel Mining and Processing (and other nonmetallic minerals except fuel).
Application Requirement
An application form for the General Permit has been enclosed. Please complete an application for the
site and submit it to our office by August 3, 1995. Note that the application must include notice of
preparation of a Stormwa[er Management Plan (SWMP), as described in Appendix A of the
application. (The plan itself does not need to be submitted.)
