The Operator shall use the following species diversity criteria for the purpose of determining
reclamation success for both the grassland and the riparian areas:
(a) A minimum of four cool season grasses, with each grass species having a minimum
relative cover of three percent. Perennial fortis (all species combined) must provide a minimum of
three percent relative cover. No individual herbaceous species which provides in excess of 60
percent relative cover can be counted toward the diversity standard. A minimum of three woody
plant species must be present in the reclaimed community. _
Reclaimed areas shall be checked annually after snowmelt for the formation of rills and
gullies. A report will be prepared to document each inspection. Rills and gullies deeper than nine
inches will be noted on the report. By the end of August of the same year, rills and gullies deeper
than nine inches will be filled, graded or otherwise stabilized. The repaired area will be seeded
mulched by the end of the same year. Mulch will be anchored to the ground with netting if
appropriate. Laborers or small equipment will be used to perform the repairs to minimize the
associated disturbance. Inspection reports will be on file with other records required under Rule
5.02.4.
The upland slope (stabilized mine bench) above Hubbard Creek shall be checked annually
after snowmelt to determine if the area is in a stable Configuration. The Division shall be notified
immediately if any areas appear unstable or have slid or slumped. In the case of a slide or slump,
the Operator shall prepare and submit a plan to the Division which will outline the corrective
measures to be taken. The plan shall address how and when the area is to be repaired and shall
address the long term stability of the area.
1131 03105
