n <br />3. Please specify the owner of the perimeter fences on the pre-mining map. <br />4. The various holding ponds and monitoring wells within 200 feet of the affected area <br />boundary may be considered as permanent man-made structures. Please include these <br />structures on all maps and list their owners. <br />5. Please ensure that the ditch to Reed Wash is not a permanent man-made structure owned <br />by a drainage district or other entity. If it is determined to be a man-made structure, please <br />list it's owner on the Pre-mine map. <br />6. Please include the CDPHE designated sub-area boundaries on the Pre-mine and Mine Plan <br />maps. <br />7. Owners of easements with structures located on them are considered to be owners of <br />record and must be notified as specified in Rule 1.6.2(el. Please ensure Grand Valley Rural <br />Power, U.S. West (Owest?), and Public Service Company (Excel?) are adequately noticed. <br />Exhibit D -Mining Plan <br />8. Topsoil piles in this climate have demonstrated poor revegetation success that will be <br />compounded by the steep slopes proposed for the stockpiles. In order to stabilize the <br />stockpiles with vegetation, please commit to stockpile slopes no steeper than 3:1 with seed <br />and mulch applied immediately following completion of stockpile construction. <br />9. Both 30-35 feet and 25 feet gravel deposit thickness are specified in the application. <br />Please clarify the thickness of the gravel deposit and correct the application text <br />accordingly. <br />t0.The overburden thickness is listed at 3 to 6 feet. Calculations in the permit use an average <br />thickness of 3.5 feet. Please provide documentation that the average depth of overburden <br />is 3.5 feet, or revise the calculations using an average depth of 4.5 feet. <br />11.Please specify the maximum amount of unprocessed, recycled material (asphalt and <br />concrete) that will be stored on site at any one time and indicate where it will be stored. <br />This material is not considered to be saleable product until it is processed. Therefore, the <br />reclamation cost estimate will include costs for on-site disposal of this material. <br />12. Please clarify whether the proposed mining activities will disturb the existing old refinery <br />landfill, aside from just covering it up. If the landfill materials, including asbestos, will be <br />disturbed and exposed, costs for remediation/removal and disposal of the asbestos and any <br />other hazardous material encountered there may need to be included in the reclamation <br />bond. If this is the case, please propose a detailed remediation/disposal plan and include <br />these costs in Exhibit L. <br />13. Please describe how operations will be conducted to ensure compliance with the applicable <br />performance standards of Rules 3.1.5 (11), 3.1.6 and 3.1.7. Either demonstrate that the <br />plumes of hazardous materials, including the RCRA metals, will not be affected by the <br />mining operation, and that the water contained or exposed in the pit at any time during the <br />life of mine meets or exceeds the NPDES discharge criteria, or submit a detailed plan, <br />
