18. The Applicant has identified its expected needs for water, the source of that water, and a plan to <br />demonstrate compliance with water laws to avoid injuring the Objectors' rights, in compliance with <br />Construction Materials Rule 3.1.6(1)(a) and 6.4.7(4). <br />19. The Applicant must also prepare and implement a plan to minimize disturbances to the prevailing <br />hydrologic balance of the affected land and of the surrounding area. The Applicant must identify <br />surface and groundwater systems, and prepaze and implement a plan to avoid unauthorized discharges to <br />surface and groundwater systems. C.R.S. § 34-32.5-116(4)(c), (d) and (h); Construction Materials Rule <br />6.3.3(1), (l), 6.4.7(2). <br />20. The Applicant's mine plan includes a storm water management plan, set forth in its drainage control <br />plans in Exhibit D, pages D-9 through D-13, as well as maps in Exhibits D-1, D-2, and D-3 and the post <br />mining drainage features in reclamation surface plan map in Exhibit F-1. The Applicant has committed <br />to replacing any water that is diverted, contingent upon State Engineer approval. The Applicant is <br />committed to divert undisturbed flow from above the mine site around the pit during mining. <br />21. The Applicant will constmct a conveyor through the center of its mine panels that includes an area for <br />storm water conveyance. The Applicant will construct a ditch with a safety berm so that drainage will <br />naturally convey down to a centralized impoundment. Once mining is finished, the panels will be <br />contoured in order to reconnect all of the preexisting drainage networks. The Applicant does not <br />propose rerouting pre-existing drainages. <br />22. The Application provides for sediment ponds to manage run-off. Discharges to drainages are permitted <br />under the Colorado Discharge Permit System, and must be monitored to ensure compliance with water <br />quality standazds and requirements. The Applicant must conduct sampling at specified points. When <br />particular constituents are identified, the samples must be tested. <br />23. The Applicant is prepared to prevent unauthorized surface water pollution discharges through its use of <br />sediment ponds and monitored, permitted discharges. <br />24. The Applicant has described surface drainages, potential impacts on the drainages, as well as planned <br />protections for the drainages, in accordance with C.R.S. § 34-32.5-] 16(4)(c) and Construction Materials <br />Rule 6.3.3(1), 6.4.7(2). <br />
