The principle limitation upon <br />the permit would be its described boundary. No extraction activity would be allowed <br />outside the "grandfathered" mining area of the E''/z SW Y. and the W'/: SE Y.. Should <br />your client wish to expand mineral extraction activities beyond said boundaries, a <br />Special Use Permit would first need to be authorized by the Pueblo County Planning <br />Commission. <br />It is my understanding that your client has been investigated for mining activity outside <br />the permitted boundary. The survey plat prepared by Valley Surveying clearly indicates <br />all mining activity is within Section 36. Therefore, the boundary violation would be that <br />boundary authorized by the Mined Land Reclamation Board and not the County. It is <br />also my understanding that, prior to 1969 there were no formal reclamation <br />requirements, and mining activities were given the opportunity to enter into voluntary <br />agreements with MLRB regarding reclamation. I will defer to your expertise as to <br />implications, but this site appears to have been an active mine since 1959, and is in <br />possession of a valid Non-conforming Use Certificate, indicating existence prior to the <br />adoption of Zoning in 1967. <br />Should your client wish to discuss mineral extraction upon the remainder of the Section <br />36, or desire to file a special use permit application for other mining activities, please let <br />me know.
