Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety received a Notice of Intent to Explore from Western <br />Fuels Association Inc for the Second Park/Cyprus Block Project on May 21, 2007. The Division has <br />assigned the number X-2007-142-I 1 to this Notice of Intent. The Division has reviewed this Notice of <br />Intent, and, in accordance with the Colorado Surface Coal Mining Act and the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining, hereby notifies you of the following: <br />Determination of Incompleteness [Regulation 2.02.2(2)[ <br />The Notice of Intent is hereby deemed "Incomplete" as of today, for the following reasons: <br />In accordance with Regulation 2.02.2(2)(b), please provide the "name, address, and <br />telephone number of the representative who will be present at (emphasis added) and <br />responsible for conducting the exploration activities". If the person who will be present <br />at the exploration activities is the person identified as the Inspection Contact (Ross <br />Gubka), please state this. <br />2. In accordance with Regulation 2.02.2(2)(c), please provide a map (or maps), at a scale <br />of 1 inch equals 1000 feet, locating all proposed drill hole access roads and drill holes. <br />This will help in our calculation of a reclamation cost estimate. <br />In accordance with Regulation 2.02.2(2)(e), please provide "a description of the basis <br />upon which Western Fuels-Colorado LLC claims the right to enter such area for the <br />purpose of conducting exploration and reclamation" for each drill hole and access road. <br />4. In accordance with Regulations 2.02.2(2)0 and 4.21.4(10), please describe how the <br />proposed activities will comply with the requirements of Regulation 4.21.4(10) <br />Office of Office of <br />Mined Land Reclamation Denver Grand )unction Durango Active and Inactive Mines <br />
