<br /> <br />EXHIBIT L, Rule 6.3.12: The County's response does not include a revised Exhibit L where <br />acknowledgement is made of the existence of a fence within 200 feet of the area to be affected by the <br />mining operation. <br />Wfiile the Division will accept that the 100 foot sepazation of the affected area and the fence is in itself <br />probably adequate to ensure that the mining operation will not affect the fence, the existence of the fence <br />and the degree of its sepazation from the petmidaffected area should be mentioned in a revised Exhibit L. <br />The new decision date for this application is September 24, 1999. Please respond to the remaining adequacy <br />issues by September 22, 1999 in order that the Division has adequate time to evaluate your response and be <br />able to consider approval on the decision date. All adequacy issues must be satisfactorily addressed or a <br />permit will not be issued. It you cannot respond completely to the adequacy issues identified above by <br />September 22, 1999, please provide a written waiver of your right to a decision on September 24, 1999 in <br />order to avoid a denial of the application and to allow the permitting process to continue. <br />if you have any questions on the above, please contact me. <br />Sincerely, <br />~la~ c <br />James C.
