Oxbow Mining, LLC <br />Permit No. 98GU0812 <br />Final Approval Colorado Department of Public Health and Environment <br />page 2 Air Pollution Control Division <br />The permit holder shall calculate emissions monthly and keep a compliance record on site in <br />order to demonstrate compliance with the above emission limitations. The permit holder shall <br />calculate annual emissions by the end of each month. Annual emissions shall be calculated based <br />on the previous twelve (12) months' emission data. These calculated annual emissions shall be <br />used to demonstrate compliance with the yearly emission limit listed above. <br />4. This source shall be limited to a maximum processing rate as listed below and aU other activities, <br />operational rates and numbers of equipment as stated in the application. Daily records of the <br />actual processing rate shall be maintained by the applicant and made available to the Division for <br />inspection upon request. Compliance with the yearly limits shall be determined on a rolling twelve <br />(12) month total. (Reference: Regulation 3, Part B,III.A.4) <br />Processing of coal shall not exceed 36,000 tons per day, and 7,000,000 tons per year. <br />Coal conveying shall not exceed 36,000 tons per day, and 7,000,000 tons per year. <br />Coal crushing shall not exceed 23,400 tons per day, and 4,550,000 tons per year. <br />Coal screening shall not exceed 18,000 tons per day, and 3,500,000 tons per year per screen. <br />Coal crushing in the rotary breaker shall not exceed 2400 tons per day, and 450,000 tons per <br />year. <br />Coal conveying in the reclaim tunnel shall not exceed 36,000 tons per day, and 7,000,000 tons <br />per year. <br />Rock loading at the Dump Station shall not exceed 274 tons per day, and 100,000 tons per year. <br />Rock dust throughput in the Rock Dust Silo shall not exceed 68 tons per day, and 13,307 tons per <br />year. <br />5. The Division's approval of the control plan is based on the submitted production level as listed <br />below. Prior to any increase in daily or annual production rates, the applicant shall submit an Air <br />Pollutant Emission Notice and Control Plan revision which will be subject to Division review and <br />approval to ensure compliance with the National Ambient Air Quality Standards for particulate <br />matter. Records of the actual production rate shall be maintained by the applicant and made <br />available to the Division for inspection upon request. Compliance with the yearly limits shall be <br />determined on a rolling twelve (12) month total. (Reference: Regulation 1, III.D.1.b.) <br />Loading of coal to trucks shall not exceed 2000 tons per day and 600,000 tons per year. <br />Hauling of coal shall not exceed 2000 tons per day and 600,000 tons per year. <br />Hauling of waste rock shall not exceed 274 tons per day and 100,000 tons per year. <br />Bulldozing shall not exceed 48 dozer hours per day and 4380 dozer hours per year. <br />The main coal stockpile shall not exceed 3.61 acres. <br />The rock stockpile in the II West Coal Refuse Facility shall not exceed 1.98 acres. <br />This activity shall not result in the exceedence of the following emissions of fugitive total <br />suspended particulates (TSP) and fugitive particulate matter of less than ten microns (PM ~a). <br />These emission limits are based on the production rates listed above. The Division assumes that <br />these levels are being met if the control measures stated in the approved control plan are followed <br />and the stated process rates are not exceeded. <br />Total Suspended Particulates: 88.89 tons per year <br />Particulate Matter (PM,o): 31.36 tons per year <br />6. The following transfer points shall be fully enclosed. Transfer point numbers are the same as in <br />the application: 8 through 27, and 29. <br />7. The following shall be partially enclosed.
