Cemfication Procedures <br />If the general permit is applicable to the applicant's operation, then a certification will be developed and the applicant will be <br />certified under this general permit. <br />a. Request for Additional Information: The Division shall have up to thirty days afret receipt of the above information to <br />request additional data and/or deny the authorization for any particulaz dischazge. Upon receipt of additional information, <br />the Division shall have an additional thirty days to issue or deny authorization for the particulaz discharge. (Notification of <br />denial shall be by letter, incases where coverage under an alternate general permit or an individual permit is required, instead <br />of coverage under this general permit.) <br />b. Automatic Coverage: If the applicant does not receive a request for additional information or a notification of denial from <br />the Division dated within thirty days of the receipt of the application by the Division, authorization to discharge in <br />accordance with the conditions of this permit shall be deemed granted. <br />c. Individual Permit Requtred: It; afrer evaluation of the application (or additional information, such as the SWMP), it is found <br />that this genera] permit is not applicable to the operation, then the application will be processed as one for an individual <br />permit. The applicant will be notified of the Division's decision to deny certification under this genera] permit. For an <br />individual permit, additional information maybe requested, and 180 days will be required to process the application and <br />issue the permit Temporary coverage under this general permit maybe allowed until the individual permit goes into effect. <br />d. General vs. Individual Permit Coverage: Any owner or operator authorized by this pemtit tray request to be excluded from <br />the coverage of this permi[ by applying for an individual CDPS permit. The owner or operator shall submit an individual <br />application to the Division, with reasons supporting the request. <br />6. Permit Certifications, Annlicable Sections: <br />The individual certification prepazed for each applicant will indicate whether Part I.B of the permit which must be followed by that <br />applicant. Part LC nnrst be followed by all pennittees unless exempted as outlined in Section III.C of the Rationale. (In the absence <br />of such indication from the Division, the permittee will be responsible for determining and then complying with the applicable <br />sections in Part I.) In addition, all nermittees will be required to comply with Part I, subparts A, D, E and F, and all of Part II of the <br />permit <br />Permit Expiration Date <br />Authorization to dischazge under this general peratit shall commence on October 1, 2002, and shall expire on September 30, 2007. <br />The Division must evaluate and reissue this general permit once every five years, and tttust recertify the applicant's authority to <br />dischazge under the general permit at such time. Therefore, any perrnittee desiring continued coverage under the general permit <br />must reapply by Mazch 31, 2007. If the permittee's individual certification does not indicate that Part 1.B of the permit must be <br />followed (i.e., the certification is for stormwater dischazges only), the perarittee must reapply by June 30, 2007 if [hey desire <br />continued coverage under [he general permit. The Division will initiate the renewal process; however, it is ultimately the permittee's <br />responsibility to ensure that the renewal is submitted. The Division will determine if the applicant tray continue to operate under the <br />terms of the genera] perarit. An individual permit will be required for any facility not reauthorized to dischazge under the reissued <br />general permit. For facilities wishing to terminate authorization under the new permit, provisions ofPart IIB.S.d will be applicable. <br />8. Inactivation of Cerrification <br />The permittee may request inactivation of their certification under this permit, once the site has been fully released from their <br />reclamarion bond requiremenss by the Colorado Division of Minerals and Geology (CDMG).
