PUBLC NOITCE CHANGES 0
UPDATE
This isforthe renewal ofrhegeneral sand and gravel permitftrst issued on October 28, 1982, with reissuances on June 10, 1987, Augu
31, 1992, and August 3/, 1997. The General Permit system jor regulating sand and gravel production operations has worked well fc'
the State of Colorado.
The following minor changes have been made to the permit and Rationale during renewal:
A. Small Municipality Exemption: The Rationale discussion on thestormwaterpermittingExemptionsforSmal/Municipalin'
(Section III.B) has been changed to include the March 10, 2003 deadline for permit coverage for municipally ownr~
industries. Thu did not involve any changes to the permit.
B. Reavplicadon: Authorization to discharge under this general permit will expire on September 30, 2007. For certificano.
coveting stormwazer discharges only (i.e., the perminee's individual certijrcatiort does nox indicate that Part I.B ojr ~
permit must be followed), the deadline for reapplicarion jor continued coverage under the general permit has been chant
to ninety-days prior to permit expiration, or June 30,1007. The due datefor perminees certifted to discharge stormwc
and process water will remain as 180 days before permit expiration, or March 31, 2007.
C. A paragraph was included in the introductory page explaining the right ofany party to an adjudicatory hearing contest
the renewal ojthis general permit, as per the Colorado Discharge Permit Svsrem ReQrtlations, Regulation No. 61, (i ~
1002-61). Nose that this does not providefor an adjudicatory heartngfor a certiftcation issued under this general per
D. Impacted Stream Se¢menu: For this general permit, any exisrirsg or new operation Char discharges ro a segment that is h
on the Division's 303(d) list ojimpacted stream segmenu may require an individual permit. The 303(d) segmenu
segmenu in which water quality standards jor one or more pollutanu are exceeded.
For most, ifnot all, ofthe operations that discharge under this permit there are no monitoring data to verify the expect
that these discharges will not impact a listed segment. Therefore, for those facilities that discharge process war
segments on the 303(d) list, the perminees will be required to perform a one-time analysis upon commencement ofdiscl
for the listed parameters ofconcern to conftrm thatstream standards for rheseparameters are not ezceeded in the disci
concentrations.
Where the receiving water is included on the state's 303(d) list, total maximum daily loads (TMDls) are being devel
accordance with the Division's schedule for TMDL completion. Once a TMDL has been established, ijit is rteces
incorporate limitations for a jaciliry certified under this general permit which are based upon the outcomes ofthe Tl~
the resvlu oftheone-time analysis, an individual permit maybe wrinen to regulate dischargesfrom thisfaciliry. The,
would conrinue ro be covered under this general permit certification until the individualpermif is issued.
IL STORMWATER PROGRAM
As required under the Clean WaterAct amendmenu of 1987, the Environmental Protection Agean,' /EPA) has established a fran
for regulating municipal and industrial stormwater discharges. This framework is under the National Pollutant Discharge Elim
Svsrem (NPDESJ program. The regulations (40 CFR 1?216) require specific types ofindusirial facilities which discharge stor
associated with industrial activity (industrial stormwater), to obtain coverage for this discharge under an NPDES permit. Fr
which discharge industrial srormwater either directly to surface waters or indirectly, through municipal separ¢re storm sewers.
covered by a permit.
