Modification Suspension or Revocation of Permits By the Division (continued} <br />5) Changing the construction schedule for a dischazger which is a new source, but no such change shall affect <br />dischazger's obligation to have all pollution control equipment installed and in operation prior to discharge; or <br />6) Deleting a point source outfall when the dischazge from that outfal] is terminated and does not result in dischazge o1 <br />pollutants from other outfalLs except in accordance with pemrit limits; or <br />g. When a permit is modified, only the conditions subject to modification aze reopened. If a petrnit is revoked and reissued, <br />the entire permit is reopened and subject to revision and the permit is reissued for a new terra <br />h. The filing of a request by the petmittee for a permit modifcation, revocation and reissuance or termination does not stay <br />any permit condition. <br />6. Oil and Hazazdous Substance Liabilirv I <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from an), <br />responsibilities, liabilities, or penalties to which the pemvttee is or tray be subject to under Section 311 (Oil and Hazazdou=! <br />Substance Liability) of the Clean Water Act. <br />7. State Laws <br />Nothing in this petatit shall be constmed to preclude the itstitution of any legal action or relieve the perrnittee from an <br />responsibilities, liabilities, or penalties established pursuant 20 any applicable State law or regulation under authority granted b; <br />Section 5 ] 0 of the Clean Water Act. <br />8. Pemttt Violations <br />Failure to comply with any terms and/or conditions of this permit shall be a violation of this permit <br />9. Pmpcrty Rieha <br />The issuance ofthis permit does not convey any property or water rights in either real or personal propetTy, or stream flows, <br />any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor a <br />infringement of Federal, State or local laws or regulations. <br />10. Severabiliri <br />The provisions of this permit aze severable. If any provisions of this permit, or the application of any provision of this permi <br />any circumstance, aze held invalid, the application of such provision to other circumstances and the application of the remain <br />of this permit shall not be affected. <br />11. Renewal.Apnlication <br />If the permittee desires to continue to dischazge, a permit renewal application shall be submitted at least one hundred eit <br />(180) days before this permit expues or ninety (90) days before the permit expires for certifications that do not indicate <br />Part 1.B of the permit must be followed (e.g., the certification is for storrrrwater dischazges only). If the permittee anticip <br />there will be no dischazge afrer the expiration date of this permit, the Division should be promptly notified so that it <br />terminate the certification in accordance with Part II.B.S. <br />12. Confiden2ialiN <br />.4ny information relating to any secret process, method of manufacture or production, or sales or marketing data which has <br />declared co~dential by the permittee, and which may be acquired, ascertained, or discovered, whether in any sam <br />investigation, emergency investigation, or otherwise, shall not be publicly disclosed by anymember, officer, or employee <br />Comrrission or the Division, but shall be kept confidential. Any person seeking to invoke the protection of this Subsc <br />shaA bear the burden ofproving its applicability. This section shall ncverbe interpreted as preventing full disclosure ofef <br />data. <br />
