SWMP Availabilirv <br />A copy of the SWMp shall be provided to the Division, the Colorado Division of Minerals and Geology (CDMG), and/or to EPA <br />upon request, and within the period specified in the request. <br />All SWMPs required under this permit aze considered reports that shall be available to the public under Section 308(6) ofthe <br />CWA. The owner or operator of a facility with stotmwater discharges covered by this permit shall make plans available to <br />members of the public upon request. However, the pertninee may claim any portion of a stormwater pollution plan as <br />confidential in accordance with Section 308 of the Federal Clean Water Act and Regulations for the State Discharge Permi[ <br />System 61.5 (4). <br />6. SWMP Preparation and Implementation <br />The SWMP shall be prepazed prior to applying for coverage under the general permit, and certification of completion <br />submitted with the application..41so, the SW:t~ shall be irttplemented when the facility begins operations, of when the <br />general petrnit certification is issued, whichever is later, and updated as appropriate. <br />Prohibition of Non-Stormwater Discharges <br />a. Except as provided in paragraph b, below, all discharges authorized by Part I.C. ofthe permit shaII be composed entirely <br />of stotmwater. Dischazges of material other than stotmwater must be addressed in Part I.B. or in a separate CDPS <br />permit issued for that dischazge. <br />b. Discharges from the following sources that aze combined with stomawater dischazges associated with mining activity <br />stay be authorized by this pemtit, provided that the non-stotmwater component of the discharge is identified in the <br />SWMP (see Part I.C.2.c.4 of the permit): fire fighting activities, uncontaminated compressor condensate, irrigation <br />drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, and foundation or footing drains <br />where flows aze not contaminated. <br />8. Record keeping and Internal Reporting Procedures <br />The permittee shall identify procedures for record keeping and internal reporting. <br />9. Emplovee Education <br />The pettrtittee shall develop and implement employee education programs to inform personnel at all levels of responsibility of <br />dte components and goals of the SWMP. Education should address topics such as spill response, good housekeeping, and <br />material management practices. The permittee shall identify periodic dates for such instruction. <br />D. Sartroling - Stormwater <br />Sampling and testing of stormwater for specific parameters under Part LC is not required on a routine basis under this <br />However, the Division reserves the right to require sampling and testing beyond this, on a case-by-case basis, at any facility <br />by this permit, in the event that there is reason to suspect chat compliance with the SWMP is a problem, or to mean <br />effectiveness of the BMPs in removing pollutants in the effluent. <br />
