Eileen Doherty on Augus± 23, 1979 concerning <br />her follow-up inspection of the Ntarr Strip i1o. 1 surface <br />mine. According to the prescribed abatement measures for <br />Violation C]o. 1 in Notice of Violation No. 79-V-5-18, Kerr <br />Coal Company ("Kerr"), the operator of the ?larr No. 1 Kline, <br />was to remove coal dust from the drainage along both sides <br />of the railroad right-of-way at its [•Ialden tipple-loadout by <br />August 10, 1979, and "reconstruct and maintain the tipple- <br />loadout facilit.~ to avoid or control adverse water quality <br />impacts" by September 7, 1979. <br />Flith respect to the August 10, 1979 deadline, Kerr <br />cleaned the drainages several times prior to 61s. Doherty's <br />inspection. At the time of her inspection, additional coal <br />accumulation was noted. Due to the location of the stockpile, <br />coal accumulation in the drainages is frequent. To control <br />the build-up, to the best of its ability until more permanent <br />solutions are found, Kerr has instituted a daily inspection <br />schedule pursuant to which an employee will visually observe <br />the drainage and report any build-up of coal dust. If such <br />a build-up is observed, employees of Kerr will take measures <br />to clean out the drainages. <br />?Vith respect to the September 7, 1979 deadline, Kerr <br />requests that the deadline be extended pursuant to 30 CFR <br />722.12 (c).
