Simpson, P.E., Assistant State Engineer <br />SUBJECT: Glass Gravel Pit, Glass Livestock Company, Inc. , La rimer <br />County #t31-22 , Application for Limited Impact Mining and <br />Reclamation Permit <br />As requested by your office, we have reviewed the application for a gravel <br />operation near Ft. Collins. The applicant mentions that a lake will be <br />formed as a part of the project which will be used for recreation after it is <br />reclaimed. Using an impoundment of water for recreational purposes, <br />including fishery or wildlife, has been defined in CRS 1973, 37-92-103, <br />as putting the water to beneficial use. A well is defined as any structure <br />or device which is ulsed for the purpose of obtaining ground water for <br />beneficial use from an aquifer. Since the source of water for the lake, <br />that will be formed ley the gravel pit operation, is ground water, we <br />consider the lake to be a "well". Prior to construction of the "well", a <br />well permit must be obtained by the application to avoid being in vio- <br />lation of CRS 1973, 37-90-137. We may have to order the applicant <br />to cease operations if our Water Commissioner determines that they have <br />begun constructing 1:he gravel pit without a well permit. <br />Since the "well" will be located in the over-appropriated Cache La Poudre <br />River basin, the applicant will have to provide an augmentation plan that <br />replaces the evaporation losses that will occur during this operation <br />and from the reclaimed lake surfaces. The augmentation plan must pre- <br />vent alterations of the prevailing hydrologic balance of the basin which <br />would injure other water rights. <br />.(4.,Q A <br />Hal D.
