• -23- ~ibit F (3 of 12) <br />authority for gravel mining or other related operations on the Leases Premises, and all such <br />permits shall be obtained prior to the commencement of any work or construction on the Leased <br />Premises. <br />5.2 Lessee shall be required to complete all reclamation work required by the State of <br />Colorado, the United States Government, or Kiowa County, and this provision shall survive any <br />termination of this Gravel Mining Lease Cor any reason. <br />VI. RECORDS AND COMMINGLINCr <br />6.1 Lessee shall be required to keep within the State of Colorado rccords and accounts <br />depicting the number of yards mined or produced or otherwise extracted Crom the Leased Premiscs, <br />the number of tons of material hauled across or through the Leased Premises, the number of tons <br />milled or otherwise processed on or Crom the Leased Premises, or other material shipped from the <br />Leased Premises including the name and location where such materials wa'e shipped, and the name <br />of the transport carrier transporting any materials from the Leased Premises. <br />6.2 Lessee shall not commingle gravel or materials mined or csuactcd Crom the Leased <br />Premiscs with any other gravel or materials, unless Lessee utilizes a weighing or measuring plan <br />and system which is sufficient for Owner to account for such gravel and usher materials removed <br />From the Leased Premises. <br />VII. AUDIT AND INSPCCT[ON <br />7.1 Owner or Owner's Agent shall have the right upon ten (10) days svriucn notice to <br />Lessee tc audit and inspect any rccords of Lessee ~whidt arc necessary to dclenninc ri>yahics due <br />here under or to determine if Lessee is complying with the prudent mining practices or required <br />reclamation plans. Owner or Owner's agent may mpy such rccords, at Owner's expenses, but such <br />records shall be kept confidential by Owner. In addition, any such audit or inspection shaft be <br />during Lcsseds normal working hours. <br />7.2 Owner or Owner's agent shall have the right to inspect the workings oC any operation <br />of Lessee on the Leased Premiscs during Lcssec's normal working hours except that such <br />inspections shall not unreasonably interfere with any opcruions oC Lessee. Any such inspections <br />under this provision shall be at the sole risk of Owner. <br />VIII. INDEMMPICA"C10N <br />3.1 During [he term or any extensions thereof of this Gravel b4ining Lease, Lessee <br />indemnifies and holds Owner harmless for any damage or injury resulting Crom the acu of Lessee, <br />its employees, or agents, because of Lessee's activity on the Leased Premiscs. <br />IX. TAXES <br />9.1 All real property taxes and assessments and sevenmce lases and assessments of any sort <br />or nature levied on the Leases Premises shall be payable by Lessee during the term of this Gravel <br />Mining Lease and any extensions thereol.
