Water Quality Control Act - 25 <br />Title 25, Article S <br />25-8-612. RII~~DIES CIJ6f[ILATIVE. (1) It is the purpose of this article <br />to provide additional and cumulative renedies to prevent, control and abate water <br />pollution and protect water quality. <br />(2) No action pursuant to section 25-8~i09 shall bar enforcerrent of any <br />provision of this article, or of any rule or order issued aursuant to this article <br />by any authorized means. <br />(3) Nothing in this article shall abridge or alter rights of action or <br />remedies existing on July 6, 1973, or after said date, nor shall any provision of <br />this article or anything done by virtue of this article be construed as estopping <br />individuals, cities, towns, counties, cities and counties, or duly constituted <br />political subdivisions of the state, fran the exercise of their respective rights <br />to suppress nuisances. <br />PART 7 <br />SELVAGE TREATT1IIv'I' N0EtIS5 <br />25-8-701. DEFINITIONS. (1) As used in this part 7, unless the context <br />otherwise requires: <br />(a) "Construction" means the erection, building, acquisition, alteration, <br />reconstruction, improvenent, or extension of sewage treatment corks; the in- <br />• spection and supervision thereof; and the engineering, architectural, legal, fiscal, <br />and econanic investigations and studies, surveys, designs, plans, working drawings, <br />specifications, procedures, and other actions necessary thereto; and any other <br />related activity which is eligible for federal aid and assistance under provisions <br />of the federal act. <br />(b) "Eligible project" means a project for the construction of public <br />sewage treafi~ent works or construction of facilities for the discharge of waste- <br />water or backwash water from public water treatment plants which is, in the <br />judgment of the cmmission, necessary for the accomplishment of the state water <br />quality control program, which conforms with applicable rules and regulations of <br />the cannission, and which is eligible for federal assistance under provisions of <br />the federal act. <br />(c) "Federal assistance" means funds available to a municipality, either <br />directly or through allocation by the state, frQn the federal government as grants <br />Por construction of sewage treatment works, or which are used for such construction, <br />under provisions of the federal act. <br />25-8-702. OONTRACTS FOR OOr'STRUCTION OF SEWAGE TREATS~Tf WORISS. (1) (a) <br />For the purpose of discharging state responsibility with respect to the protection <br />of public health and in order to assist municipalities, the ccrmission, in the <br />nacre of the state and to the extent of state funds appropriated therefor, shall <br />enter into contracts with municipalities concerning the following types of eligible <br />projects: <br />• (I) Construction of sewage treatment avrks excluding their interceptor and <br />collection lines and pumps and appurtenances associated with such lines; <br />-25- <br />
