(1) If sarrq~lr~s of water or water <br />pollutants are taken for analysis and a violation of any permit or control regt,- <br />lation is suspected, a representative portion of the sample shall be furnished <br />upon request to the person who is believed to be responsible for such suspected <br />violation. A representative portion of such sargle shall be furnished to any <br />suspected violator whenever any remedial action is taken with respect thereto b}' <br />the division. A duplicate of every analytical report pertaining to such sample <br />shall also be furnished as srxm as practicable to such person. <br />(2) Any information relating to any secret prrx•es5. rtwt.hcxl of manufar•tur~ <br />or production, or sales or marketing data, which ria}• Ue acyuiracJ, ascertainr~d. <br />or discovered, whether ir, any samplinK im•estigation, ~riienr}~ incre5ti,ation. <br />or otherwise, shall not be publicly disclosed by any m,c~rmber, ufficer, or etr¢,loyc~r, <br />of the cQrmission or the division, but shall be kept cr,ni'idential. This section shall navc~r he interprFtcd as <br />preventing full disclosure of effluent data. <br />25-806. RUL,IS C>f' CIL'IL PROCmURE -APPLICABILITY. Gxcept as otherwise <br />specified in this article, service of process, notices, and other papers shall <br />be in accordance with the Colorado rules of civil procedure. <br />PART 5 <br />PI;Fi.`9IT Sl'STEI <br />25-8-501. PDl.1fITS RDQUIRID FYJR DISCILARGE OF POLLUTA.\'TS - ACk1ItiISIRATIO::. <br />(1) No person shall discharge any pollutant into any state water from a point <br />source without first having obtained a permit frim the division for such discharge. <br />Fach application for a permit duly filed under thF federal act shell be deemed to <br />be a permit application filed under this artic•]e, and each permit. issued pursuant <br />to the federal act shall be deatx~ci to be a tr~rrx~rary permit issued under this <br />article which shall expire upon expiratir~n of the federal permit. <br />(2) The division shall examine applications for and may issue, suspend, <br />revoke, modify, dopy, and otherwise administer permits for the discharge of <br />pollutants into state eaters.
