MDNITCRING, R~(Xf{DING, AND RF~TIi~. (1) The owner or oper- <br />ator of any facility, process, or activity fran which a discharge of pollutants <br />is made into state caters or into any municipal sewage treatment corks shall, <br />in such form and in accordance with such specifications as the division may <br />require: <br />(a) Establish and maintain records; <br />(b) Make reports; <br />(c) Install, calibrate, use, and maintain monitoring methods and equipment, <br />including biological monitoring methods; <br />(d) Sample discharges; <br />(e) Provide additional reasonably available information relating to dis- <br />charges into public sewage treatrnent works. <br />25-8-305. ANNUAL REPOffI' TU T13E CCivAffSSION. On or before October 1 of each <br />year, the division shall report to the cannission on the effectiveness of the <br />provisions of this article and shall include in such report such recrnn~endations <br />as it may have with respect to any regulatory or legislative changes that may be <br />needed or desired. Such report shall include the then current information that <br />has been obtained pursuant to section 25-8-303. <br />25-8-306. AUI~RITY TD FATII2 AND INSPEXT PRII~fISFS AND Rte. (1) The <br />division has the power, upon presentation of proper credentials, to enter and <br />inspect at any reasonable time and in a reasonable manner any property, premise, <br />or place for the purpose of investigating any actual, suspected, or potential <br />source of water pollution, or ascertaining compliance or noncmopliance with any <br />control regulation or any order promulgated under this article. Such entry is <br />also authorized for the purpose of inspecting and copying of records required to <br />be kept concerning any effluent source. <br />(2) In the making oP such inspections, investigations, and determinations, <br />the division, insofar as practicable, may designate as its authorized repre- <br />sentatives any qualified personnel of the department of agriculture or of the <br />department of natural resources. The division may also request assistance from <br />any other state or local agency or institution. <br />(3) If such entry or inspection is denied or not consented to, the division <br />is empowered to and shall obtain from the district or county court for the judicial <br />district or county in which such property, premise, or place is located, a warrant <br />to enter and inspect any such property, premise, or place prior to entry and in- <br />spection. The district and county courts of the state of Colorado are empowered <br />to issue such warrants upon a proper showing of the need for such entry and in- <br />spection. <br />• 25-8-307.
