conduct an inspection to assess site conditions. If site conditions differ from those in the <br />approved reclamation plan, the Permittee shall be advised to revise the permit <br />accordingly. The Division shall also verify that the site, if left as requested, is erosionally <br />and geotechnically stable, and that there aze no health or safety issues. Also, if there aze <br />any possible non-compliance situations, such as water rights issues, or county ]and-use <br />issues, those must be addressed by the Permittee prior to revision approval. <br />If the site in its unreclaimed state is geotechnically or erosionally unstable, if there aze <br />health or safety issues, or if there aze other issues of possible non-compliance that could <br />ordinarily be addressed under the Mined Land Reclamation Act, and the landowner after <br />having been notified. of these circumstances still refuses to provide the Permittee access <br />to the property, then the issue shall be scheduled for a hearing before the Boazd. <br />It is the Permittee's responsibility to provide the Division the names, addresses, and <br />phone numbers of all current owners of record to the affected land. This includes both <br />surface and mineral owners. <br />It is the Division's responsibility to notify the landowner by certified, return receipt mail <br />that the Permittee has submitted a revision to the Division to leave the site in its present <br />non-reclaimed condition. <br />Once the revision is approved, the Permittee shall submit a release request according to the <br />requirements of the Act, Rules and Regulations. <br />1n the event any of the above issues cannot be resolved, the matter should be scheduled for a <br />Boazd hearing: To the extent possible, all affected parties should attend. <br />This policy is not applicable and cannot be used where the landowner and the <br />Permiltee are the same person. <br />Clpolicyheleasr/chg post min ]end use rcc plan <br />
