Walther <br />Executive Director <br />Ronald W. Cottony <br />Ailing Division Director <br />The Division received a letter from Denver Water regazding final reclamation of the Hazeltine <br />Pit. Both the Operator and Denver Water should be awaze of the approved reclamation plan and <br />post-mining land use for the mine site. The approved reclamation plan requires the completion of <br />certain tasks in order to achieve the approved post-mining land use. Those tasks cannot be <br />revised or changed unless the permit is amended. And, if reclamation is not completed pursuant <br />to the approved reclamation plan, the Operator cannot be released from reclamation <br />responsibility. <br />I have enclosed a copy of the Mined Land Reclamation Boazd's latest policy that outlines <br />various procedures that must be followed in order to change the reclamation plan or the post- <br />miningland use for mine sites where the "landowner wants to leave the site substantially in its <br />mined condition to satisfy a land use different from that approved in the permit." <br />As always, it does not matter who does the reclamation, just that the reclamation is completed <br />pursuant to the approved permit. <br />Adams County has been assigned to the South Team so, if you need additional information, or if <br />you just want to discuss the problem, you can contact Mr. Harry Posey, Acting Senior <br />Environmental Protection Specialist, at 303-866-3567 or give me a call at 303-866-4060. <br />I will send a copy of this letter to Denver Water, Mr. Michael L.
