.~ <br />. f7"._ i. <br />Serial No. C-So447 <br />• CONTROLLED SURFACE USE STIPULATION <br />GENERAL FOREST <br />Surface occupancy or use is subject to the following special operating <br />constraints. <br />Underground mining operations will result in surface subsidence. The <br />operator/lessee shall perform a study co secure adequate baseline data to <br />quantify the existing surface resources on and adjacent to the lease area. <br />Existing data may be used if such data is adequate for the intended <br />purposes. The study shall be adequate to locate, quantify, and demonstrate <br />the inter-relationship of the geology, topography, surface hydrology, <br />vegetation and wildlife. Baseline data will be established so that future <br />programs of observation can be incorporated ac regular intervals for <br />comparison. <br />The operator/lessee shall establish a monitoring system to locate, measure <br />and quantify the progressive and final effects of underground mining <br />activities on the topographic surface, underground and surface hydrology <br />and vegetation. The monitoring system shall utilize techniques which will <br />provide a continuing record of change over time and an analytical method <br />for location and measurement of a number of points over the lease area. <br />The monitoring shall incorporate and be an extension of the baseline data. <br />• If subsidence activates a landslide which adversely affects surface <br />resources, or a documented water loss, the operator shall (where <br />applicable): <br />1. Restore stream channels and surface drainage or protect scream <br />flow with earthwork or temporary culverting; or <br />2. Restore affected roads; or <br />3. Revegecate as necessary to protect against erosion; or <br />4, Restore or replace surface structures or compensate the owner of <br />those surface structures: or <br />5. Provide ocher mitigation (cahich could include water augmentation, <br />restoration, or replacement). <br />On lands described below: <br />National Fozest System Lands within the entire lease. <br />For the purpose of: <br />To insure the stability of surface resources and facilities during and <br />after the coal mining operations. <br /> <br />
