continued public and coal operation access to the Dry Fork of Minnesota <br />Creek area: <br />Forest Development Road 711.2 - Dry Fork of Minnesota Creek Road. • <br />Forest Development Road 711.2B - Apache Rocks Road. <br />The non-system exploration road which junctions with the Apache Rocks Road <br />and goes in a generally easterly direction to west Platiron is not open to <br />public full-size vehicular traffic, but is necessary for continued <br />activities associated with coal mining in the West Flat Iron area. <br />All three of these roads are granted exceptions. <br />For the purpose of: <br />The management of wetlands and floodplains are subject to Executive Orders <br />11990 and 11988, respectively. The purpose of the EO's are to avoid to the <br />extent possible the long and short term adverse impacts associated with the <br />destruction or modification of wetlands and floodplains and to avoid direct <br />or indirect support of new construction in wetlands wherever there is a <br />practical alternative. <br />Also, it is recognized that there is a direct relationship between impacts <br />on such areas and effects on water quality and aquatic ecosystems. There <br />is a high risk of irreversible and irretrievable impacts on the latter with <br />operation and developments in wetlands, floodplains and riparian areas. <br />It may become necessary for a waiver, exception or modification (WEM) to. <br />this..stipulation for the operator/lessee to use the surface in the azea <br />covered by this stipulation to allow for the recovery of the cdal reserve. <br />WEM's to this stipulation will be considered only at. the time operations <br />are proposed, and will be subject to the Forest Land and Resource <br />Management Plan in. effect at the time of consideration, sad will be subject , <br />to applicable regulatory. and environmental. compliance requirements. <br />Granting of. a WEM is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right to impose other stipulations in the same~azea of this leasehold if a <br />~WEM is~graated. <br />Conditions under vhieh n 9PDI~may be granted: <br />If it can be shown through environmental analysis sad the application of <br />mitigation measures that the impacts to wetland, floodplain and riparian <br />resources will be minimized and that no other alternative location for <br />facilities and activities associated with coal mining is practical because <br />of environmental effects and operational considerations (eg, economics, <br />health and safety, etc.) <br />Aay chnngss to this stipulation will be made in accordance with the land use <br />play sad/or the regulatory provisions for sueh~ehanges. {For guidance oa the <br />use of this stipulation, nee BLM Manual 1624 and 3400 or FS Manual 1950 and <br />2820.) <br />Coal-NSO-WFR 2/95 <br />\I <br />
