Rights of claims of par ties in possession not shown by the pu hli r. rocoids. <br />2. Easements, or claims of easements, not shown by the public records. <br />3. Discrepancies, conflicts in boundary fines, shortage in area, encr oath merits, and any (acts which a Corr e. ct <br />survey and inspection of the premises would disclose and which are not shown by the public records. <br />4. Any lien, or rig ht to a lien, (or ser vices, labor or material theretofore or hei ea(Ier furnished, imposed by law <br />and not shown by the public records. <br />5. Defects, liens, encu mbi an yes, adverse claims or other matters, if any, ci eared, first appearing in the public <br />records or attaching subsequent to the effective date hereof but prior to the date the pro posed insured acqunes <br />of record for value the estate or interest or mortgage thereon covered by this Commitment. <br />6. Any and all unpaid taxes and assessments. <br />7. Any law, ordinance or governmental regulation (including but not limited to <br />building and zoning ordinance) restricting or regulating or prohibiting the <br />occupancy, use or enjoyment of the land, or regulating the character, dimensions, <br />or location of any improvement now or hereafter erected on said land, or pro- <br />hibiting a separation in ownership or a reduction in the dimensions or area <br />of any lot or parcel of land. <br />8. The effect of inclusion in any general or specific water conservancy, 1'i re <br />protection, soil conservation or other district or inclusion in any water service <br />or street improvement area. <br />9. Right of the proprietor of a vein or lode to extract and remove his ore there- <br />from, should the same be found to penetrate or intersect the premises hereby <br />granted as reserved in United States Patent recorded February 15, 1897, in <br />Book 12 at page 449 as Reception No. 19921. <br />10. Right of way for ditches or canals constructed by the authority of the United <br />States as reserved in United States Patent recorded February 15, 1897, in Book <br />12 at page 19921. <br />11. A strip of land being 50 feet wide on each side of a center line as conveyed <br />to the Rio Grande Junction Railway Company by Warranty Deed recorded April <br />10, 1896 in Book 38 at page 454 as Reception No. 19243, as the same may affect <br />subject property. <br />12. A strip of land 33 feet wide for irrigation ditch purposes as conveyed to Wm. <br />R. Willcox by Special Warranty Deed recorded June 10, 1901 in Book 54 at page <br />23 as Reception No. 23938, as the same may affect subject property. <br />13.
