This plan provides for measurement <br />and recording of the quantity and quality of all discharges from the <br />permit area. The frequency, density and accuracy of monitoring will <br />allow Kerr Coal to evaluate and determine the success of mine plans, <br />treatment facilities and reclamation for the purpose of minimizing <br />disturbance to the hydrologic balance and assuring success of the <br />proposed postmining land use. The plan sukxni.tted at Section 780.21 (b) <br />addresses the operations, reclamation and postmining phases of <br />hydrologic monitoring. <br />Data collected over the course of the water-year from October through <br />september, will be submitted to the regulatory agency on or before <br />January 31st of the following year. Since Kerr Coal reports discharges <br />in accordance with the Clean water Act of 1977 on a quarterly basis (see <br />• E~chtbit 33, NPDFS Permit #Q~-0030724) Kerr Coal will notify the <br />regulatory authority of NPDES report filings as provided by 30 CFR <br />816.52(b)(iii)(B). The regulatory authority will be notified by Kerr <br />Coal of any possible noncomplying discharges within five days of <br />receiving analytical results indicating possible non-compliance. Where <br />noncompliance with an NPDES permit effluent limitation has occurred, <br />Kerr Coal will forward the analytic results concurrently with the <br />written notification of noncompliance. <br />~/~ Section 816.53 Hydrologic balance: Transfer of wells. <br />(a) An exploratory or tmnitoring well may only be transferred by the person <br />who conducts surface mining activities for further use as a water well with <br />the prior approval of the regulatory authority.
