• Section 816.491a) Continued. <br />(7) The impoundment will be suitable for the approved postmining <br />land use. <br />Sedimentation Ponds A, B, D, and E have been approved by the <br />DMG for retention as permanent impoundments to support <br />postmining 1 and uses. Kerr also plans to evaluate the <br />feasibility of retaining Pond F as a permanent impoundment <br />for stock watering purposes. Documentation of compliance <br />with the applicable criteria of Rule 4.05.9(13) for permanent <br />impoundments is provided in Exhibit 92, Drainage and Sediment <br />Control Plan. <br />(b) Temporary impoundments of water in which the water is <br />impounded by a dam shall meet the requirements of 30 CFR 816.46 <br />(3) - (u) . <br />Seven impoundments were constructed in the Mine Plan Area as <br />sedimentation ponds, as shown on Map 16a, Kerr Mine Area <br />Surface Water Hydrology. Four of these impoundments have been <br />• approved as permanent impoundments, one will be evaluated in <br />the future for retention as a permanent impoundment, and two <br />will be reclaimed. At the tipple, a temporary impoundment in <br />the form of a sedimentation pond has been constructed, as <br />shown on Map 17a, Kerr Tipple Area Hydrology. These <br />impoundments are discussed in detail under Sections 780.21, <br />780.2, and 816.46 and, as demonstrated in the above- <br />referenced Sections, will mee[ the requirements of 30 CFR <br />816.46 (e)-(u). <br />(c) Excavations that will impound water during or after the mining <br />operation shall have perimeter slopes that are stable and shall <br />not be steeper than 2v;lh. Where surface runoff enters the <br />impoundment area, the side slope shall be protected against <br />erosion. <br />Fs described and referenced under Section E16.96, all <br />impoundments will have stable perimeter side slopes that are <br />ne steeper than 2v:lh.
