Storage shall be limited to the period until burial or <br />treatment first becomes feasible. Acid-forming or toxic-forming spoil <br />to be atoned shall be placed on impermeable material and protected from <br />erosion and contact with surface water. <br />Acid-forming or toxic-forming materials do not exist within the <br />overburden to be removed by the proposed mining activities. A <br />detailed and thorough program of sampling, analyzing, and data <br />compilation has been conducted. Full discussion of the chemical <br />characteristics of the overburden is presented under Section 779.14. <br />Results of the testing are presented in Table 73, Chemical Analysis <br />of Overburden. <br />~/r Section 816.49 Hydrologic balance: Permanent and temporary <br />J f( impoundments. <br />(a) Permanent impoundments are prohibited unless authorized by the <br />regulatory authority, upon the basis of the following demonstration: <br />(1) The quality of the impounded water shall be suitable on a permanent <br />basis for its intended use, and discharge of water from the impoundment <br />shall not degrade the quality of receiving waters to less than the <br />water-quality standards established pursuant to applicable State and <br />Federal laws. <br />(2) The level of water shall be sufficiently stable to support the <br />intended use. <br />(3) Adequate safety and access to the impounded water shall be provided <br />for proposed water users. <br />816-63 <br />
