I • Section 816.46(d) Continued. <br />elevation of the dewatering device be located below the <br />elevation of the calculated maximum sediment storage volume. <br />Finally, all primary outlet structures are designed so that all <br />outflow which occurs as a result of a 10-year, 24-hour <br />precipitation event passes through the primary outlet and that <br />none flows through the emergency spillway. <br />(e) Each person who conducts surface mining activities shall design, <br />construct, and maintain sedimentation ponds to prevent short-circuiting to <br />the extent possible. <br />Short-circuiting will be prevented by effecting proper design <br />considerations. Ali ponds will be constructed so that the primary <br />outlet device (riser) is located as far away as practical from the <br />major point of inflow. In addition, baffles have been designed and <br />placed in ponds C, D and F to assure that short-circuiting does not <br />occur. All of the above design considerations will be used to <br />achieve the proper detention time and prevent short-circuiting. <br />(f) The design, construction, and maintenance of a sedimentation pond or <br />other sediment control measures in accordance with this Section shall not <br />relieve the person from compliance with applicable effluent limitations as <br />contained in 30 CFA 816.42. <br />Kerr Coal recognizes that many of the performance requirements <br />originally set forth in 30 CFR 816,42 have been withdrawn by OSM. <br />816-52R Revised - January, 1991 <br />
